The suit was filed on April 19 in federal court in New Orleans.

On September 10, 2010, the woman was shopping at the Kmart store in Mandeville when she slipped in water and fell. She claims her accident was caused by a water leak between the checkout counters, which was in plain view of two or more cashiers.

The suit seeks more than $900,000 in damages to cover lost wages, medical expenses, mental anguish, disfigurement, court costs and interest, emotional distress and more.

What to do if you are injured in a slip and fall

First and foremost, if you are injured while visiting an establishment, notify the owner or manager that you have been hurt. Ask them to call an ambulance if needed. Medical attention should be your main priority.

If there is water on the floor, be sure to document it by the use of pictures or witnesses. Even if there is no dispute that the company is at fault, such as water on the floor, the injured person must prove that the store owner knew about the issue and failed to fix it.
