The widow of an East Rockaway worker electrocuted while supervising track work at a Queens Subway station will file a $50 million wrongful death lawsuit against the city.
Jackie Knell filed a notice to sue on July 22, charging numerous violations at the work site when her husband slipped and fell on the wet subway track on April 26. The state was “grossly negligent” in allowing workers to repair subway tracks under unsafe conditions.
Last month it was reported that preliminary findings of the tragedy highlighted numerous safety concerns, including Knell lugging 90 pounds of spikes when he allegedly lost his balance. Also, according to Knell’s attorney, the “boards protecting the third-rail were removed and there was no signage or lights alerting employees of the exposed rail."
